Prosecutors decide to retry four Miami officers

MIAMI, Florida (AP) -- Federal prosecutors said they will retry four Miami police officers accused of planting evidence or covering up misconduct after a jury deadlocked over whether they were guilty.

Prosecutors on Friday filed a notice of intent to retry Jose Acuna, Jorge Garcia, Israel Gonzalez and Jose Quintero, The Miami Herald reported. No trial date has been set.

The defendants were among 11 police officers who stood trial on corruption and other charges, in what was part of Miami's biggest police scandal in a generation.

Jurors on April 9 convicted four officers of conspiracy and obstruction of justice while acquitting three others of all charges, but could not reach verdicts in the other officers' cases.

Acuna was acquitted of two counts but remains charged with participating in a cover-up involving a 1997 shooting of a homeless man.

Gonzalez and Garcia are charged with conspiracy, perjury and obstruction of justice based on statements they made following the shootings of suspects Antonio Young and Derrick Wiltshire.

Young and Wiltshire were 19 when they were shot to death while fleeing a tourist robbery. Prosecutors claimed neither was armed; the defense insisted they were.

Quintero faces conspiracy charges for allegedly planting a gun in the alley where Wiltshire was shot.
